Soundiron Privacy Policy

SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?

We take your privacy and time very seriously, so we collect only the minimum information necessary to process your order and issue your license and we only send newsletters and emails out to our subscribers and customers when we think we have something important to tell you. When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.  When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system. 

Email marketing (if applicable to you):

When you sign up for our newsletter, we may send you emails about our store, new products and other updates. We don't send more than 4 newsletters in a single month. We will not automatically opt you into our mailing list or send you marketing emails that you have not signed up for.

If you do not sign up for our newsletter, you will only get the following emails from us that are necessary for purchase, delivery and activation of your products after you have bought one of our products:

  • order confirmations
  • order receipts
  • download links
  • activation codes
  • product support, update and upgrade notices for Soundiron products that you already own

SECTION 2 - CONSENT

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only. If we ask for your personal information for a secondary reason, like marketing, we will ask you directly for your expressed consent through our voluntary mailing list sign up form.

How do I withdraw my consent?

If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by contacting us at support@soundiron.com or:

SECTION 3 - DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service. For example, we may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights. In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

SECTION 4 - SHOPIFY

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. SECTION 5 - THIRD PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us in the course of normal order processing and to facilitate website functionality. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand how your personal information will be handled by these providers.

When you click on links on our store, they may direct you away from our site. Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

SECTION 6 - SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

SECTION 7 - USAGE DATA

We collect Device Information using cookies, log files and web beacons. “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org. “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps. “Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Site.

We use the Order Information that we collect to fulfill any orders placed through the Site, including processing your payment information, issuing you licenses and download access for our products and providing you with invoices and/or order confirmations. Additionally, we use this Order Information to communicate with you; Screen our orders for potential risk or fraud; and, when in line with the preferences you have shared with us, to provide you with information or advertising relating to our products or services. We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

SECTION 8 - AGE OF CONSENT

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

SECTION 9 - CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it. If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to provide customer support for products you have purchased. 

SECTION 10 - PERSONAL DATA ACCESS AND REMOVAL

When you order products from us, we will maintain your order Information for our records unless and until you ask us to delete this information. However, please be aware that when you buy a product from our store, you are purchasing a license to possess and use Soundiron's intellectual property. When you buy a product license from us, we are granting you permission to use our intellectual property to generate new content for your own commercial purposes. This basic aspect of intellectual property licensing requires us to maintain customer licensing records in perpetuity. Therefore, without exception, by ordering any of our products, you are affirmatively agreeing to irrevocably grant us the right to register and store your name, email address, date(s) of purchase(s), product(s) purchased, serial number(s), download code(s) and IP address(es) in perpetuity. If we are unable to store this information, we cannot grant the intellectual property license that you are required to have in order to download, own and use any of our products for any reason. If you are uncomfortable sharing this basic licensing information with us, please be aware that we will be unable to license our content to you, due to the user-specific nature of the intellectual property licenses we sell.

You can contact us at any time to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. However, if you have purchased a product from us in the past and no longer wish to allow us to maintain this necessary licensing data, you must affirm your understanding that your license and rights to use our products will have to be revoked in the process of doing so. No unlicensed or anonymous use of our intellectual property is permitted.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, Soundiron is based entirely in the United States of America, so please note that your information will be transferred outside of Europe, including to Canada and the United States when visiting our site and ordering our products.
